# The Mail Ballot Rule: A Judge Says They Violated Her Order

On 11 August a federal judge in Boston barred the Postal Service from even writing the rule that would carry Trump's mail-ballot executive order. On Friday 22 August, in the evening, after the courthouse had closed for the weekend, USPS sent a 95-page final rule to the Federal Register. It was stamped to take effect on the 21st, five days before it was published and anyone outside could read it.
On Monday the Supreme Court lifted a different injunction, the one covering 23 states and DC. That order was unsigned, 6-3, and it did not say the executive order was lawful. It said the judge had moved too early.
On Tuesday Judge Indira Talwani answered in five pages: the defendants "cannot contend that they misunderstood the scope of the court's order." She found they had violated it, and wrote that they had feigned complete compliance when they asked the Supreme Court for an emergency stay in July.
The rule published on 26 August. The Postal Service remains barred from using it for the 2026 election.

The SCOTUS stay is the story every outlet ran. The story underneath it is a calendar, and it is live TODAY: The quote the reel is built on — Talwani, on DOJ complaining it had only two business days: they object "despite USPS creating the emergency by issuing a rule on a Friday evening after the courts were closed." The other primary-source fact: USPS acknowledged both injunctions inside the final rule and said it will not implement it for the 2026 election unless the government obtains relief. So the rule publishes tomorrow and is inert tomorrow. That is the whole point. VERIFIED, with one correction to the seed. On Monday 24 August 2026 the US Supreme Court granted the DOJ's emergency application in Trump v. California (No. 26A124, consolidated with 26A139) and stayed the JUNE injunction of US District Judge Indira Talwani (D. Mass., Boston), which had blocked Executive Order 14399 — "Ensuring Citizenship Verification and Integrity in Federal Elections", signed 31 March 2026 — across a coalition of 23 states plus the District of Columbia (24 jurisdictions, AGs and governors). The order was unsigned and reported 6-3: Justice Ketanji Brown Jackson dissented, calling it a "Kafkaesque nightmare" injecting "chaos and uncertainty" into the midterms; Justice Sotomayor dissented, joined by Justice Kagan. The mail-in ballot win for the president could be short-lived.
That is how almost every newsroom described Monday. The Supreme Court did hand this administration a win, and it is a real one, but it is not the win the headlines described and the stranger thing had already happened three days earlier, on a Friday night after the courts had closed.
In March, the president signed an executive order on federal elections. It would make states hand the federal government a list of every voter they send a mail ballot to. And it would let the Postal Service refuse to carry those ballots in any state that did not comply. Two federal courts blocked it.
On the 11th of August, a federal judge in Boston named Indira Talwani told the Postal Service to stop. Not only to stop acting on the order, but to stop writing the rule at all.
On Friday the 22nd, in the evening, after the courthouse had closed for the weekend, the Postal Service sent a 95-page final rule to the Federal Register. It was stamped to take effect on the 21st, five days before anyone outside the building could read it.
The groups who had won the injunction filed an emergency motion over the weekend. The judge refused to give the government more time to answer and wrote that the Postal Service had created the emergency itself by issuing a rule on a Friday evening after the courts were closed.
Then on Monday, the Supreme Court lifted the other injunction, the one that covered 23 states and the District of Columbia. The order was unsigned. The vote was 6 to 3. And it did not say the executive order was lawful. It said the judge had moved too early.
The rule appeared in the Federal Register this morning, and inside its own pages, the Postal Service says it will not use it this year unless a court sets it free. A rule a judge forbade, filed after hours, binding before it was readable and inert by its own admission. 69 days from an election.
On Tuesday, the judge answered in five pages. The defendants, she wrote, cannot contend that they misunderstood the scope of the court's order. She found that they had violated it. And she wrote that when they asked the Supreme Court for an emergency stay in July, they had feigned complete compliance.
